What's a Process Agent of the BOC-3?

A process agent is someone who can accept legal documents on behalf of a motor carrier, broker, or freight forwarder if they are involved in a court case. For motor carriers, they need to designate a process agent for each state they operate in or travel through. For brokers, they need to have process agents listed in each state where they have an office or where they make contracts.

How Do I Appoint a Process Agent?

To designate a process agent, a company should reach out to a process agent who can submit to the FMCSA. Only one form is needed, which should cover all the states where the company operates. The company must keep a copy of the BOC-3 form at its main office.

Companies can choose any blanket company from the process agent list, and they're not limited to their home state. Each blanket company works with a process agent in every state.

The responsible party must submit the signed original copy here, a signed copy must be kept by the carrier, broker, or freight agent, and sent acopy in each state where you operate or pass through. If you need to make changes to the designation, you can only do so by submitting a new BOC-3 form to the FMCSA. You only need to send copies of the new designations to the states affected by the change or new submission. You can make individual or blanket designations.
